Welcome to the Exercise Thresholds App ("we," "us," "our," or the "App"). We are committed to protecting your privacy and being transparent about how we handle data. This Privacy Policy explains our data practices for the Exercise Thresholds App available at https://www.exercisethresholds.com.

Our Privacy-First Approach: The Exercise Thresholds App is designed with privacy as a core principle. We do not require user accounts, do not track your activities, and process most data directly in your browser without sending it to our servers.

1. Information We Collect and Process

1.1 Exercise Physiology Data You Upload

When you use the App, you may upload exercise and spirometry datasets (CSV, Excel, or other supported formats) containing physiological measurements such as:

  • Gas exchange data (VO₂, VCO₂)
  • Ventilatory parameters
  • Heart rate
  • Power output or speed
  • Lactate measurements
  • Other exercise-related metrics

Important: We do not require or request any personally identifiable information (name, email, date of birth, etc.) in these datasets. All data processing is anonymous and happens entirely in your browser.

1.2 Data Created in the Exam Feature

When instructors create practice exams using our Exam feature, the following anonymous data is temporarily stored on our servers:

  • Exercise datasets for the exam cases
  • Exam questions and configurations
  • Student responses and scores (anonymous, no identifying information)

This data is automatically deleted 30 days after the exam end date.

1.3 Technical Information

We do not use analytics, tracking cookies, or any third-party tracking tools.

2. How We Process Your Information

2.1 Browser-Based Processing (Client-Side)

The vast majority of data processing happens entirely in your web browser:

  • File uploads and analysis
  • Data visualization
  • Most interactive features

This means your data never leaves your device for most App functions.

2.2 Server-Side Processing (Limited Cases)

Your data is sent to our servers only in these specific situations:

a) PDF Report Generation

When you request a PDF report of your analysis, anonymous spirometry data is transmitted to our server to generate the document. The data is processed and immediately discarded after the PDF is created.

b) Oxynet AI Analysis

When you use the Oxynet feature for AI-assisted threshold detection, anonymous spirometry data is sent to our server for analysis. The data is:

  • Processed by our deep learning algorithms
  • NOT used to train or improve AI models
  • Immediately discarded after analysis is complete
  • Never stored or retained

c) Exam Feature

When creating or participating in exams, anonymous data is stored temporarily (see Section 1.2) and automatically deleted after 30 days.

2.3 Purpose of Processing

We process data solely for the following purposes:

  • To provide educational tools for learning exercise physiology concepts
  • To enable threshold detection and analysis features
  • To generate reports of your analyses
  • To facilitate practice exams for educational purposes
  • To maintain and improve the App's functionality
  • To ensure security and prevent abuse

3. Data Retention and Deletion

Depending on your location, you may have the following rights:

5.1 European Union (GDPR)

If you are in the EU/EEA, you have the right to:

  • Access: Request confirmation of what data we process
  • Rectification: Correct inaccurate data
  • Erasure: Request deletion of your data
  • Restriction: Limit how we process your data
  • Data Portability: Receive your data in a structured format
  • Object: Object to processing based on legitimate interests
  • Withdraw Consent: Withdraw consent at any time (where processing is based on consent)

5.2 United States (State Privacy Laws)

If you are a resident of California, Virginia, Colorado, Connecticut, Utah, or other states with privacy laws, you may have rights including:

  • Right to know what personal information is collected
  • Right to delete personal information
  • Right to correct inaccuracies
  • Right to opt-out of data sales (note: we do not sell data)

Canada: Rights under PIPEDA to access and correct personal information.

Australia/New Zealand: Rights under the Privacy Act 1988 (Australia) and Privacy Act 2020 (New Zealand) to access and correct personal information.

Please note: Because most of our App operates without collecting personal information, many of these requests may not apply. For example, if you only use browser-based features, we have no data about you to access, delete, or correct.

6. Legal Basis for Processing (GDPR)

Under GDPR, we process data based on:

  • Legitimate Interests: Operating an educational research tool (Article 6(1)(f))
  • Consent: Where you explicitly choose to use server-based features like Oxynet or PDF generation (Article 6(1)(a))
  • Legal Obligation: Compliance with applicable laws (Article 6(1)(c))

7. International Data Transfers

Our servers are located in the European Union. If data is transferred internationally, we ensure appropriate safeguards are in place, such as:

  • Standard Contractual Clauses (SCCs) approved by the European Commission
  • Adequacy decisions for transfers to countries with equivalent protection
  • Your explicit consent for specific transfers

8. Data Security

We implement appropriate technical and organizational measures to protect data, including:

  • Encryption of data in transit (HTTPS/TLS)
  • Secure server infrastructure

  • Immediate deletion of temporary data after processing
